ON THIS______DAY OF _________200_, AND IN CONSIDERATION OF THE MUTUAL COVENANTS HEREIN CONTAINED, THE FOLLOWING IS HEREBY AGREED BETWEEN THE PARTIES HEREAFTER REFERRED TO AS " CLIENTS " AND "KC" FOR KurzCorp.
1. Upon receipt of $599.00 , KC will reserve the following accommodations for clients. These funds shall be applied to defray a portion of the expenses associated with KC's costs related to the inspection trip. In the event a Home purchase is made with KC at the inspection site during the inspection trip, the funds will be applied to either the down payment or the closing costs associated with the purchase. THE INSPECTION TRIP SHALL INCLUDE;
A. Double occupancy for 3 days and 2 nights. ( subject to availability )
B. Inspection shall be limited to the following areas: Cape Coral, Florida - LeHigh Acres, Florida - Naples, Florida - Venice, Florida - and Charlotte, North Carolina.
C. Round trip air transportation as referenced above. Itinerary changes by clients are strictly prohibited.
D. Continental breakfast for two.
All other incidental expenses and charges are the sole responsibility of the Client.
2. Clients understand and agree that KC is not a common carrier, and as such assumes NO responsibility associated with the entire Inspection Trip. In addition, any monetary loss associated with the Client's cancellation of the Inspection Trip shall be the full and total responsibility of the Client. KC has the right to cancel the Inspection Trip for any reason what-so-ever, with full refund to the Client.
3. The Inspection Trip is subject to the approval of KC, and shall primarily be based upon, but not limited to, the financial qualifications of the Client. Should the Client fail to qualify for the Inspection Trip, the entire deposit shall be refunded.
4. In the event any provision or provisions of this Agreement , in whole or part, shall conflict with the laws of the State of New York, or otherwise be unlawful, such provision or provisions shall be null and void, but the remainder of this Agreement shall be in full force and effect.
5. This Agreement shall be construed in accordance with the laws of the State of New York. Any litigation arising from this Agreement shall be adjudicated in the proper jurisdiction in the city of
New York.
6. This Agreement contains the full and complete understanding of the parties.
